1. Scope

1.1 These General Terms and Conditions (GTC) of "Atelier Sandra Kolondam" apply to all contracts concluded between a consumer or entrepreneur (hereinafter referred to as "Customer") and the seller concerning the goods and/or services presented in the seller's online shop. The inclusion of the customer's own conditions is hereby rejected unless otherwise agreed.

1.2 These GTC also apply accordingly to the purchase of gift vouchers unless expressly regulated otherwise.

1.3 A consumer, according to these GTC, is any natural person who concludes a legal transaction for purposes that predominantly are outside their trade, business, or profession. An entrepreneur, according to these GTC, is a natural or legal person or a partnership with legal capacity, acting in the exercise of their trade, business, or profession when concluding a legal transaction.


2. Conclusion of the Contract

2.1 The product descriptions contained in the seller's online shop do not constitute binding offers from the seller but serve to provide a binding offer by the customer.

2.2 The customer can submit the offer via the online order form integrated into the seller's online shop. After placing the selected goods and/or services in the virtual shopping cart and completing the electronic ordering process, the customer submits a legally binding contractual offer regarding the goods and/or services contained in the shopping cart by clicking the button that completes the order process.

2.3 The seller can accept the customer's offer within five days:

  • by sending the customer a written order confirmation or an order confirmation in text form (e.g., email), in which case the receipt of the order confirmation by the customer is decisive;
  • by delivering the ordered goods to the customer, in which case the receipt of the goods by the customer is decisive;
  • by requesting payment from the customer after placing their order.

The contract is concluded when one of the aforementioned alternatives occurs first. If the seller does not accept the customer's offer within the aforementioned period, this is considered a rejection of the offer, with the consequence that the customer is no longer bound by their declaration of intent.


3. Right of Withdrawal

3.1 Consumers generally have a statutory right of withdrawal.

3.2 Detailed information about the right of withdrawal can be found in the seller's withdrawal policy.

3.3 The right of withdrawal does not apply to consumers who, at the time of contract conclusion, do not belong to a member state of the European Union and whose sole residence and delivery address are outside the European Union at the time of contract conclusion.

3.4 Digital products (such as downloadable wallpapers) are files made immediately accessible after purchase. Please understand that as the digital product cannot be returned, there is no right of withdrawal once the file has been downloaded.


4. Prices and Payment Terms

4.1 Unless otherwise stated in the seller's product description, the prices listed are total prices, including statutory VAT.

4.2 Additional costs, such as shipping fees or customs duties, may apply to deliveries outside the European Union and are borne by the customer.

4.3 Customers have access to various payment methods indicated in the seller's online shop.

4.4 If advance payment is agreed upon, the payment is due immediately after the contract's conclusion.

4.5 Payments processed via PayPal, Wix Payments, or Klarna are subject to the respective provider's terms and conditions.


5. Delivery and Shipping Terms

5.1 The delivery of goods is generally carried out via shipping to the delivery address specified by the customer.

5.2 Should the shipping company return the shipped goods to the seller due to an unsuccessful delivery attempt, the customer bears the costs of the unsuccessful shipping unless the circumstances leading to the impossibility of delivery are beyond the customer’s control.

5.3 Customers may pick up their goods at the seller's location after arranging a pick-up time. In this case, no shipping costs are incurred.


6. Redemption of Gift Vouchers

6.1 Gift vouchers are available for purchase in the seller’s online shop and can be redeemed in the same shop.

6.2 Vouchers and remaining balances are valid until the end of the third year after the voucher’s purchase date.

6.3 Gift vouchers can only be redeemed before completing the order process.


7. Redemption of Promotional Vouchers

7.1 Promotional vouchers issued free of charge during promotional campaigns are only valid during the specified period and for the specified online shop.

7.2 Promotional vouchers are not exchangeable for cash and cannot be combined with other offers.


8. Liability for Defects

The statutory liability for defects applies.


9. Applicable Law

9.1 All legal relationships between the parties are governed by the laws of the Federal Republic of Germany.

9.2 For consumers, this choice of law only applies to the extent that it does not deprive them of the protection provided by mandatory provisions of the law of the state where the consumer resides.


10. Usage Rights for Digital Products

The digital products offered, including downloadable wallpapers, are intended solely for personal use. Any commercial use, sharing, reproduction, or distribution is prohibited. Upon purchase, you acquire a simple, non-transferable right to use the product for personal purposes.
